TERMS & CONDITIONS:
Eligibility
1. The Dell SURPRIZE Promo Contest (“Contest”) is open to all customers who buy a Dell Inspiron/XPS (Laptop or Desktop)
for home usage during the Contest Period (defined below). Participants must be citizens/permanent or residents of Malaysia
and aged eighteen (18) and above (herein referred to as “Customers” or “Participants”).
2. All Customers must have valid SERVICE TAG NUMBERS from PCs purchased during the Contest Period to be eligible for the
Contest and prizes.
3. The following persons shall not be eligible to participate in the Contest:

1. Customers purchasing Dell Inspiron/XPS (Laptop or Desktop) for office/business purpose
2. Employees (permanent and/or contract employees) of Dell and their immediate family members;
3. Employees (permanent and/or contract employees) of Bates141 its subsidiaries and affiliates and their immediate family members, and their promotional agencies.

Contest Period
4. The Contest Period shall run from 24 June 2008 until 28 July 2008 both dates inclusive (“Contest Period”).

The Contest
Direct From Dell
5. Customers who buy a Dell Inspiron/XPS (Laptop or Desktop) during the Contest Period from Dell Direct (Online, Phone or
Direct Store) will automatically be eligible to enter the Contest.
6. At the end of the Contest Period, 3 short-listed candidates (which include customers who had purchased through Dell Direct
(online, phone or Direct Stores) and the Retail outlets will be selected by an electronic selection system (subject to terms &
conditions as determined by Dell).
7. The prizes (“Prizes”) for the Contest are as follows: - 3 prizes worth MYR 5,000/- each in the form a holiday package from Dell
appointed travel agent. Destination of holiday package will be determined by Dell. Terms & conditions of participating travel

8. Dell and/or their contracted representatives will contact each short-listed participant. The short-listed participant will have to
answer a question relating to Dell correctly in order to obtain the Prize. The Prize winners will be notified immediately if they are
successful in obtaining the Prize.
9. The Prize winners shall be bound by further terms and conditions as determined by Dell at its sole discretion.
10. The prize will be delivered to the winner’s address (which has to be same as the order’s shipping address).
11. Should there be any cancellation, return or refund of the ordered system, the customer/prize winner will be automatically
being disqualified from receiving the prize.
12. Where customer returns the Dell™ system ordered pursuant to Dell’s Total Satisfaction policy, all prizes won shall also be
returned at the same time and on the Terms and Conditions of Sale, Service and Technical Support. Where customer cancels
the order upon which the customer had redeemed the prize(s), Customer agrees to either:

1. Return the prize(s) redeemed in original packaging, undamaged at customer’s expense; or
2. Authorize Dell to charge the cost of prizes redeemed to customer’s credit card account as stated in the order sheet.

Customer shall agree to either (a) or (b) at time of cancellation, failing which Customer hereby agrees to authorize Dell in accordance with option (b) without need for any further reference.

13. Dell reserves the right at anytime at its absolute discretion without prior notice, to substitute any of the Prizes with other
items of similar value.
14. Prizes are non-transferable and not exchangeable for cash and each Prize winner is eligible to win only one (1) Prize.
15. Dell reserves the right to choose the specifications of the Prizes and Dell’s decision on this matter is final.
16. All winning Customers shall accept the prize(s) as they are and subject to any terms and conditions which may be attached
thereto. Dell makes no representation, warranty or undertaking whatsoever as to any implied terms or conditions
with respect to any reward awarded in this Promotion. Dell assumes no liability or responsibility whatsoever in respect
of any defect or deficiency in any of the prizes.

Retail
17. Customers who buy a Dell Inspiron/XPS (Laptop or Desktop) during the Contest Period from retail outlets will be given a
Contest registration form. Customers will have to complete the form and drop it into the submission box provided at the
retail outlets.
18. Other terms and conditions are as per Clauses 6 to 16 above and Clauses 19 to 26 below.

Miscellaneous
19. By entering or participating in the Contest, participants will deemed to have read, understood and agree to be bound by these
terms and conditions and agrees that the decisions of Dell regarding the Contest and all matters relating to or in connection
thereto are final and binding and no queries, appeals or correspondences will be entertained. Dell reserves the right to
change the mechanism of the Contest and/or amend, delete or add on these Term and Conditions without prior notice to
the participants, and the participants agree to be bound by such amendments.
20. Non-compliance by the Customers, contestants and/or winners with any of the terms and conditions herein shall entitle
Dell to disqualify any entry and/or revoke any prize awarded.
21. Dell reserves the right to cancel, terminate, suspend, shorten or extend the Contest at anytime prior to the expiry of the
Contest without prior notice. For the avoidance of doubt, cancellation, termination, suspension, shortening or extension by
Dell of the Contest shall not entitle the participants to any claim or compensation against Dell for any and all loss or
damage suffered or incurred by the participants as a direct or indirect result of the act of cancellation, termination, suspension
shortening or extension of the Contest.
22. Dell reserves the right to use the names, addresses, photographs, information and documents of the Customers,
Participants, contestants and/or winners in advertisements, other form of publicity or future marketing purposes from
time to time and participation of the Customers, Participants, contestants and/or winners in the Contest constitutes their
consent to such use, without further payment or consideration or notice.
23. Dell shall not be held responsible or liable for any claims of loss or damage to property or personal injury or loss of life
by the Customers, Participants, contestants, winners and/or any party resulting from or arising out of or in connection with this
Contest or the prizes given under this Contest.
24. These terms and conditions prevail over any provisions or representations contained in any brochure or other
promotional materials advertised under this Contest.
25. In the event of any dispute, conflict, uncertainty or ambiguity relating to the Terms and Conditions hereto, or any matter
involving this Contest, Dell will resolve the matter in its absolute and unfettered discretion and the entire decision
in the matter shall be conclusive and final.
26. The Terms and Conditions are governed by Malaysian law and any dispute arising out of or in connection with them shall
be subjected to the exclusive jurisdiction of Malaysian Courts.

Terms & Conditions of Travel Warrant

1. The Travel Warrant is redeemable for any travel related services such as air transportation, accommodation or sightseeing tour package
2. The original Travel Warrant must be presented with a suitable identification at the time of reservation.
3. You are advice to make your reservation at least 30 days before your intended departure date.
4. All confirmations of bookings is subjected to flights and hotel availability
5. This Travel Warrant is not redeemable in part or full for cash. Should the claim be less than the amount specified, the balance amount is not refundable or transferable.
6. If the travel arrangements exceed the amount stated, the excess amount are to be paid/borne by the holder of the Travel Warrant
7. The Travel Warrant is made good only in exchange for travel agent services effective 1st Sep 2008 and must be utilized by 1st Aug 2009. The Travel Warrant is deemed null and avoid upon expiry. Extension on the validity date will not be entertained
